LIMITED WARRANTY

Palladium warrants, subject to the conditions and limitations listed herein, that Palladium products are provided free from defects in materials or workmanship that result in peeling, flaking, blistering, corroding, or rotting, during normal and intended use, for a period of 20 years from the date of purchase. This Warranty applies to the original purchaser only and is not transferable. No warranties, expressed or implied, are made to any purchaser for resale. The product must be purchased from an authorized Palladium distributor or dealer and installed, operated, and maintained in accordance with instructions published by Palladium, or this Limited Warranty is void.

This warranty period shall be administered as follows:

-Any failures in material or workmanship for the first ten (10) years shall be compensated by either full replacement of the defective items or reimbursement by Palladium at the original purchase price.

-Any failures in material or workmanship for years 11-15 shall be compensated by replacing defective items at 75% of their original value or reimbursement by Palladium of 75% of the original purchase price for the defective items.

-Any failures in material or workmanship for years 16-20 shall be compensated by replacing defective items at 50% of their original value or reimbursement by Palladium of 50% of the original purchase price for the defective items.

Any claims under this Limited Warranty must be made by the original purchaser to :

Palladium Wood Products, 120 Dockside Drive, Salisbury, NC 28146. Claims must be received within the warranty period and promptly after the discovery of the claimed defect. Claims must include proof of purchase, photographs of the defective material sufficient to show the nature and extent of the claimed defect, and a written description of the claim. Palladium reserves the right to investigate any claim hereunder. A reasonable amount of time shall be allowed for such investigation..

Palladium’s liability under this Limited Warranty is limited solely and exclusively to the remedies provided hereunder, and, in no event, shall Palladium be liable for labor, installation, reinstallation, freight, taxes, or and other charge related to defective product. Palladium does not warrant gates, hardware, installation, defects caused by installation, or an insurable loss.

This Limited Warranty is void with respect to any of the following events related to the product: 1) misuse, abuse or vandalism; 2) accident, lack of proper maintenance or impact of objects; 3) tornado, hurricane or other violent storm, flood, fire, pollutants, or acts of God; 4) alteration by application of heat, welding, solvents, paint, chemicals, or any other alterations not recommended by Palladium. Events beyond Palladium’s control shall not be considered defects under this Limited Warranty and are not in any way covered by this Limited Warranty.

This Limited Warranty may not be altered or amended except in a written instrument signed by Palladium and Palladium purchaser. No dealer or other person or entity is authorized by Palladium to make statements or representations regarding the performance of Palladium products except as contained in the Limited Warranty, and Palladium shall not be bound by any such statements.

By acceptance and use of this product, the purchaser agrees that Palladium’s liability and the purchaser’s remedies for any alleged breach of warranty shall be limited to the repair or replacement of the product, or the refund or the purchase price, at Palladium’s option, as provided herein.

In no event will Palladium be liable for any incidental or consequential damages of purchaser, or for any punitive, exemplary or other damages of any kind whatsoever, whether any claim is based upon theories of contract, warranty, negligence, tort, strict liability, or otherwise.

The foregoing limited warranty is exclusive and in lieu of any and all other applicable warranties, express or implied, including without limitation, any implied warranty of merchantability or fitness for a particular purpose.

Some states do not permit limitations on the duration of implied warranties or exclusions or limitations on the duration of implied warranties or exclusions or limitations of incidental or consequential damages. This Warranty gives you specific legal rights. You may also have other rights which vary from state to state.
